Water Analytics Warranty Policy

  1. Warranty Policy

At Water Analytics, we are committed to delivering high-quality products that meet your needs and expectations. This Warranty Terms and Conditions document outlines the warranty coverage and limitations for our products. Please read this document carefully before using or purchasing any of our products.

All new Water Analytics sensors and controllers carry a minimum one-year Limited Warranty from the date shipped from the factory against defects in materials and workmanship, see product manuals for extended warranty periods. We promise that your product will be defect-free in materials and workmanship. No warranty, expressed or implied, is made regarding any product’s merchantability or fitness for a particular purpose.

 

  1. Exclusions and Limitations

By purchasing at Water Analytics, whether you place your order online or by telephone, you acknowledge that you have had an opportunity to review the Water Analytics warranty terms, have done so to the degree you need to be familiar with them, and you accept their terms and conditions, including the limitations, exclusions, and disclaimers in them.

The warranty will not cover product failure, any defect and/or malfunction that is caused as a result of misuse, failure to follow operating instructions (Use and Storage), abuse, use with improper or faulty equipment, improper handling or user modifications. It doesn’t cover incidental damage.

Any repairs or modifications performed by unauthorized personnel will void the warranty.

The warranty will not cover normal wear and tear, cosmetic damage, or aesthetic changes that do not affect the product’s functionality.

 

The warranty will not cover Damage caused by accidents, acts of nature, or other external causes.

Except for the limited warranty expressly set forth or to the extent restricted or prohibited by applicable law, Water Analytics expressly disclaims any and all other warranties express or implied, including any warranty of quality, merchantability, or fitness for a particular purpose, and you specifically agree that Water Analytics shall not be liable for any special, incidental, indirect, punitive, or consequential damages for breach of any warranty of any type on any Water Analytics product. In addition to and without limiting the generality of the foregoing disclaimers, the limited warranty does not, under any circumstances, cover the replacement or cost of any external devices, personal property, or lost time compensation.

 

  1. Documentation

To help process warranties Water Analytics will require that customers submit a filled-out copy of our RMA request form, at which time the customer will be issued an RMA number to reference on their return. Water Analytics does not assume responsibility for the loss of any materials sent to them without an issued RMA number.

 

  1. Repair and replacement

If a valid warranty claim is made within the warranty period, Water Analytics will, at its discretion:

  1. Repair the product using new or refurbished parts,
  2. Replace the product with a new or refurbished product of equal or similar functionality,
  3. Provide Credit equal to the original purchase price

or

  1. Refund the original purchase price of the product.

 

  1. Consumables

Water Analytics does not warranty consumable products, which includes, but is not limited to reagents, salt bridges, and solutions.

 

  1. Credit Returns

Returns for credit, outside of warranty claims, may be made within the first 30 days of receipt of products. All credit return items must be in new and unused condition, in their original packaging, and be accompanied by a return authorization number. Water Analytics reserves the right to charge a 25% restocking fee on all credit returns.

 

  1. CHANGES AND ADDITIONAL CHARGES

Water Analytics reserves the right to make design changes or improvements to any products of the same general class as Products being delivered hereunder without liability or obligation to incorporate such changes or improvements to Products ordered by Buyer unless agreed upon in writing before the Products’ delivery date. Services which must be performed as a result of any of the following conditions are subject to additional charges for labor, travel and parts: (a) damage resulting from improper use or handling, accident, neglect, power surge, or operation in an environment or manner in which the instrument is not designed to operate or is not in accordance with Water Analytics operating manuals; (b) the use of parts or accessories not provided by Water Analytics.

  1. Limitation of Liability

To the maximum extent permitted by law, Water Analytics shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use or performance of its products, even if advised of the possibility of such damages.

In no event shall the total liability of Water Analytics exceed the amount paid by the purchaser for the product, giving rise to the claim.

 

  1. Product Misuse and Indemnification

The purchaser acknowledges that the use of the product outside of its intended purpose or in a manner not consistent with the provided instructions may result in damage, injury, or loss. The purchaser agrees to indemnify and hold Water Analytics harmless from any claims, liabilities, damages, or expenses arising from such misuse.

 

  1. Intellectual Property

Water Analytics and its technology partners retain all rights, title, and interest in its intellectual property associated to their respective products, including but not limited to patents, trademarks, copyrights, and trade secrets.

The warranty does not grant the purchaser any rights or licenses to use Water Analytics’ intellectual property, except as necessary to utilize the product.

 

  1. Force Majeure

Water Analytics shall not be liable for any delay or failure to perform its obligations under these warranty terms and conditions if such delay or failure is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorist attacks, strikes, or government regulations.

 

  1. Disclaimer of Other Warranties

Except for the express warranty stated above, Water Analytics disclaims all other warranties, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

These warranty terms and conditions constitute the entire agreement between Water Analytics and the purchaser regarding the warranty coverage for its products and supersede any prior or contemporaneous understandings, representations, or agreements, whether written or oral.

 

  1. Governing Law and Jurisdiction

These warranty terms and conditions shall be governed by and construed in accordance with the laws of Massachusetts, United States. Any dispute arising from or relating to these terms and conditions, or the use of Water Analytics’ products shall be subject to the exclusive jurisdiction of the courts in Massachusetts.

If any provision of these warranty terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
